Am I legally required to provide the listing agent/broker with a copy of my agency disclosure form or my exclusive buyer agency agreement?
No. The law does not require you to share a copy of these forms with the listing agent/ broker. However, the West Michigan Regional Purchase Agreement has a paragraph that puts the listing agent/broker on notice of the selling licensee’s agency status since it could have an impact on the amount of compensation (if any) that is being shared with the cooperating broker. While the law does not require the sharing of either form, some listing agents/brokers might opt to request a copy of the buyer agency agreement and some selling licensees might opt (but are not required) to share that information (potentially with private information redacted).
