Are the sellers final signatures in paragraph 37 sellers receipt of the purchase agreement required in order for the agreement to be binding?
An offer is binding at the point where the seller accepts the offer and delivers written notification to the buyer or the buyer’s agent, OR where the buyer accepts the seller’s counter offer and delivers notification to the seller or seller’s agent. It is not necessary for the Seller’s Receipt Section of the West Michigan Regional Purchase Agreement to be complete in order for an offer to be binding. The West Michigan Regional Forms Committee included that paragraph simply to provide proof that written notification was received, but it isn’t required for an offer to be binding.
