At what point is an offer considered binding?
An offer is binding at the point where the seller accepts the offer and delivers written notification to the buyer or the buyer’s agent (or where the buyer accepts the seller’s counter offer and delivers written notification to the seller or seller’s agent). It is not necessary for the Seller’s Receipt Section of the PA to be completed in order for an offer to be binding. The West Michigan Regional Forms Committee included that paragraph simply to provide proof that written notification was received, but it isn’t required for an offer to be binding.
