How do I know which items remain with a property and which items should be reserved by a seller?
The Fixtures & Improvements Paragraph in the West Michigan Regional Listing Agreement provides a list of improvements and appurtenances that are included in the purchase price, unless rented (in which case, the rented items should be disclosed to cooperating brokers). If the seller wants to reserve some of those affixed items, that information should be disclosed on the MLS and reiterated in the purchase agreement (remember, the terms of the purchase agreement supersede the listing information). The list of items referenced in the listing agreement is not all-inclusive, so please be sure to have a conversation with your seller about the items they plan to take with them. To determine if something is affixed, it is often thought of in this way – tip the house upside down and shake it. What doesn’t fall out is affixed and remains, unless reserved.
