NEW LISTINGS
Submission of listings to the MLS
New exclusive right-to-sell listings to be submitted to the MLS within 1 business day from the start date on the listing agreement. In the event that the listing is unable to be submitted within 1 business day, the Delay of Submission of Listing to the MLS Addendum to the West Michigan Regional Listing Agreement (i.e. Delay Addendum) may be used to identify the date that the listing will be submitted to the MLS.
Marketing to the public may occur within the above-referenced 1 business day timeframe unless the Delay Addendum is being used. If the Delay Addendum is utilized, the Seller, Listing Agent, and Listing Broker all agree that no marketing will occur until the date that the listing has been submitted to the MLS.
Documents uploaded to the MLS:
- Primary Exterior Photo – 72 Hours – The primary exterior photo must be uploaded to the MLS within 72 Hours from the date that the listing becomes active on the MLS. Practically speaking, it is ideal to load the photos immediately since new listings are automatically distributed in data feeds to third party websites at the top of each hour.
- Listing Agreement – Immediately – The listing agreement must be uploaded to the MLS as part of the process of adding a new listing to the system. Failure to provide a listing agreement will incur a fine and could cause the listing to be cancelled. This requirement is to insure that the listing is being submitted with the Seller’s informed consent, and that the person signing the listing agreement has the authority to convey title.
- Seller’s Disclosure Statement – Immediately – Unless the property is exempt from the requirements of the Seller’s Disclosure Act, the fully completed Seller’s Disclosure Statement must be uploaded to the MLS as part of the process of adding a new listing to the system. Failure to comply will incur a fine and could cause the listing to be cancelled.
- Lead-Based Paint Disclosure – Immediately – Unless the property is exempt from the state requirements, the Lead-Based Paint Disclosure must be uploaded to the MLS as part of the process of adding a new listing to the system. Failure to comply will incur a fine and could cause the listing to be cancelled.
- Reserved Buyers – Up to 5 Days – The MLS will permit prospects to be reserved for up to 5 days from the contract start date.
Changes to existing listings on the MLS
- Amendments – Immediately – In the event that the price, terms, or other contractual details of a listing are being changed, it is necessary to upload an amendment.
SALES
Pending Sales
3 Calendar Days – GRAR’s MLS Rules & Regulations calls for pending sales to be reported to the MLS within 3 calendar days from the date that the title holder and the buyer agree by signature on a purchase agreement.
The active/contingent status may be used as an alternative to pending in limited circumstances:
- A short sale where the seller has accepted an offer, but is still awaiting lender approval of the short sale
- A bankowned property where the bank has given verbal acceptance of the offer, but paperwork is still in process
- A property that is subject to approval by a relocation company. In all cases, the status must be transitioned to pending once the proper approvals and signatures are in place. Closed Sales
3 Calendar Days – Closed sales must be reported to the MLS within 3 CALENDAR days. There is a fee for failure to report a closed sale in a timely manner. If you encounter an unreported closed sale, you may submit an anonymous report by using the Report Violations Tool in the upper right hand corner of the page report on the MLS.
